Ebay Frustration & Question

I recently bought a wireless controller for the original Xbox off eBay.

Although the photo only showed the (second hand) controller, the listing did not mention that the receiver part was not included. However, when the item arrived the receiver was missing. I sent the sell a message:

"Hi, I received the Logitech wireless controller (for Xbox) today. However, the receiver (model number C-X3B18) for this controller was not in the package. Given that your 'item description' did not state that the receiver was missing, I assume that this is a mistake. Please could you forward the receiver to me at the same address at your earliest convenience.
Regards ..."

The reply came back as:

"Hi there.
Thank you for your purchase and I am sorry you assumed the receiver was included but I have listed it separate for £10 on eBay
Regards..."

So basically they are selling the receiver separately! But the listing did NOT mention this. I have double checked.

Is there a way I can log this with eBay/ pay pal as 'item not received' (as part of it is missing as far as I am concerned)?

I want to keep the controller as they are REALLY hard to get hold of, but I hate being swindled like this. What do you reckon folks?

    To continue, I seem to remember years ago someone locked up my PayPal account because they said I had not sent an item and I had to refund them.

    To be honest, I would like to do this to the seller in question until the receiver is sent... Can you do this?

  • If it's not in the photo or in the written in the description then never assume that the item is complete or working.
    If the seller describes the item as working and it needs the receiver to work it then you may have a good point!

    You can get him to accept a return due to item not matching description. He has used a catalogue description, which is wrong, he has used one for a ps2 thrust master, hence use this fact instead of the fact something is missing.

  • I'd argue that the receiver, despite not being connected, is an integral part of the controller, since without it there can be no control. The item description should have been clear that this part was being sold separately or was missing.

    A bit underhanded of the seller tbh, so I'd open a dispute with ebay regardless of his claims of innocence. If it came to the worst, I'd send it back for a refund on principle.
  • I think the fact the receiver was being sold separately (and they told me this) confirms it was deliberately underhand. Otherwise, I may have assumed it was someone who didn't know any better - someone who didn't even know there was a receiver...

  • Play him at his own game - order the receiver and then claim non-receipt.

  • I'm tempted to ask the seller a question and say 'why did you not sell this with the controller' you listed a few days back.

    I would not buy his IR receiver, let him be stuck with it the greedy conning B*stard!!

    You mean when a question comes up on a listing? That won't work, as the seller can control whether or not it appears (unlike Amazon)

  • Haha... That's like selling a TV and then listing the remote control separately... And then not including any batteries for the remote... :))

    I'd just give him negative feedback and buy the receiver from somewhere else.

    Open a case:
    It says "is fully operational and functions as intended."
    As it is described as "CORDLESS WIRELESS CONTROLLER" then it does not function as intended!
    If he had described it as without receiver then you'd be at a loss, but not here, the buyer would assume that the receiver IS included since it is described as "fully operational and functions as intended.".

    Tell him you want a refund or the receiver sent to you or you will open a case, be polite!
    I know this is frustrating and be patient but I think eBay will side with you! (provide correspondence as proof too.)

  • Indeed. Without the receiver it just isn't a " WIRELESS CONTROLLER FOR XBOX ". Intentional or not, it is a misleading description.

    couple of sellers here clearly pointing out no receiver included, so your man is probably in the wrong...

    "I felt disappointed with your response as it cannot be used without the receiver. Your title and item description failed mention that the receiver was ‘not included’ or ‘sold separately’.

    I would not have bid if I had been aware of this fact. I assumed that this was an oversight and gave you the benefit of the doubt, as I can see that your feedback is very good.

    Over £30 for a controller that my son cannot even use, and he has been after one of these for months.

    I have discussed this situation on a couple of internet forums. Pretty much all the responses I have received agree that I have not received what I have paid for – a working, “fit for purpose”, controller. I have received half the controller – the bit that connects:- missing.

    I am being heavily urged to take this matter further with Ebay/Paypal, but I am reasonable, so I will ask again that you send the missing receiver to me, or a £10 credit to my Paypal account, to cover the cost of buying a receiver.

    I received an apologetic response and the receiver is now (hopefully) on the way.

    I've had similar before.. each category has a thing "used" or some go into detail e.g. vgood/good/acceptable... either way you have to state it is incomplete and in that section as the main bit to make it "operable" is missing..

    I had someone sell me a QL , the PSU was missing!! and the seller was being a *cough* about it. so ended up 3 weeks and they dug their heels in.. ebay sided with me, told me to keep it AND they refunded me the full amount.

    people who sell the parts e.g. psu / computer as separate do *cough* me off.

    even if a booklet is missing , I'll mention it .. that way I never get anyone trashing my feedback and the few who did try it. I had proof they were doing it on purpose.. e.g. "slow postage" when it was posted next morning etc.

    I only get losers who never bought off me "commenting" on me as a seller.. this year may turn out to be rather costly for a few of them (I have a year to "deal" with such comments on social media) . Or various tyre kickers who don't want to buy the item anyway, just send me dunce messages

  • Just to let you know, when the receiver turned up, there was an 8 meg official Xbox memory card left stuck in it. Bonus! That'll cover the hassle, thanks...
