Ebay advice.
Oh look, it's another ebay rant.
Got myself a bit worked up over this one and would really love some advice... I just bought a collectors edition joystick on a buy it now... limited edition, 1 of 5000 globally... the description text reads as follows -
Arcade stick to Sony Playstation 1, 2 & PSONE. The Arcade stick is BRAND NEW, COMPLETE and UNUSED.
The photo shows box, joystick and instructions.
Now, the item arrived and I know what should be in there... I've seen them before. The brand new item comes with -
The Arcade stick
Instruction booklet
A pack of unopened trading cards
A Flyer
BUT... what I got was a clearly worn box, inner packing missing, a joystick which has had its rubber hand rests perished with sweat ( yes, this is an assumption based on experience with rubber hand rests ) and the instruction booklet.
Now, the seller is still selling this item which proves he has more than one and the one I got is not the one pictured ( the one pictured the rubber looks fine, a nice shade of red, not powdery faded to white. )
He says the joystick is unused, the rubber has just perished as it is 11 / 12 years old and the cards and flyer weren?t listed or pictured...
So, BRAND NEW, COMPLETE and UNUSED should have been interpreted as how the seller sees his stock, not an indication of how it left the factory.
I would let it slide, but I been after this item for a while and sold some things just to get the ?70 for the buy it now.
What should I do? Is it another Item I should chalk up to experience for not getting sellers definition of 'Brand New, Complete and Unused' right?
Any advice gratefully received.
cheers peeps

if it's mis-described then , have words.. and if they are "don't care" involve ebay, you used paypal hopefully ?
if it's not as described, then don't feel a way about it.. esp. if it's REALLY mis-described.
notice here, something I'm selling.. http://www.ebay.co.uk/itm/271013278625
although brand new (still in the case) , there were blemishes (and probably with all of em) I still mention it to NOT get any BS later.
Small Claims Court - last resort.
not worth it, ebay will force them to refund the money as long as you pay with paypal.. I had one that was well "sure" they had 1 over on me, ebay got a FULL refund back, without having to return it.
the only way I'd give it back is if they refunded the money + return postage *BEFORE sending it* . anything else, they can swivel for
Or a couple of "NOT @ ALL FORGED, 100% GENUINE!!!!" ?50 notes.
that changes it a bit, funny how some foreign folk lose the ability to speak english when there is an issue.. been there.. done that.
Unlucky. I've bought lots of stuff from europe and beyond and have been very very lucky up until now... In fact, the best of the best sellers I deal with seem to be from Finland, Germany and Japan/China. ( I love them coz they always put 'gift' on the import docs )
The worst I've dealt with I'm sad to say seem to be in the UK. BUT... that's the ebay experience... we've all got a different one.
Didn't read everyone elses response....so forgive me if I duplicate.
If they don't satisfy you...
Start a dispute with ebay and or paypal...if they said complete unused and it is not...you will get your money back or partial refund if you agree to it and they will get the joystick back or offer the partial refund..and bad feedback
And Thanks all!
I have an apology and a sizeable reimbursement to cover my inconvenience so happy camper once again.
It seems the cards and flyers were added by some shops and not standard by the factory, which I have had confirmed by another collector.
So? that?s one down? And off we go again? Ordered and original release Tekken 5, crappy platinum version turns up with the postman today?
This retro collecting is turning into hard work!
Grrr.
Always remember, you are only after what you believe you are paying for. They have / are ripping you off, not the other way round.
good luck trying to find speccy games in wh smiths or woolies then ;-)
the majority of sellers / buyers are fine.. if something is listed as new , then thats a different matter.
you buy 12's ? it's a bit like that , someones version of "mint" is a bit different from someone elses.
I remember buying my copy of Batman AA on PS3 in Gamestation a while back. I was very particular to pick up an original box and the the platinum release, but the girl at the counter just gave me the platinum version. She looked at me funny when I said I wanted the original box and not the re-release version, even though the stuff inside is the same. I don't think I own any platinum games on PS3 or xbox360 (I do have one or two PS2 games though, but that's only because I got them for a couple of quid a piece)
A friend of mine has been selling all her boyfriends LP's off (he does know she's doing so btw  ) and she's being very careful with how she lists those. She makes a note of every bump, fold etc on the sleve and inner. Mind you, some of what she's selling is very rare, even by eBay's R@RE standards and are mainly one off Black Metal, Death and Thrash stuff. She's earned a fortune selling his collection off!
Yeah, I've heard vinyl is a bit of a pain in the boobs to buy/sell via eBay. Shame really, I've got a bunch of stuff to sell, but don't know if I can be arsed with the grief of it all...
I've been buying Vinyl the last couple of months off Ebay..only had 2 that I had issues with (out of about 25 I've bought) and the sellers gave me a full refund on both.
As always buy off someone with a lot of feedback and read it first.
Some of the grading is a bit off I have to say but it's great for hard to find albums etc.
This was a "buy it Now" so covered by the distance selling regulations. [as long as it was sold in the UK.]
ebay / paypal is enough to put the wind up em anyway 90% of the time.
